Welcome to SwadPay.com. These Terms and Conditions govern your use of the website and services operated by SwadPay Technologies Private Limited.
1. Acceptance of Terms
By accessing or using our website, digital QR code menus, POS services, or kitchen terminal applications, you agree to comply with and be bound by these Terms. If you do not agree, you are prohibited from using the platform.
2. Services Rendered
SwadPay provides a software platform helping restaurants digitize their ordering flow (Dine-In menu display, kitchen terminal routing, and digital checkouts). We do not cook, prepare, or handle food. Food quality, preparation times, and accuracy remain the sole responsibility of the registered Hotel/Restaurant Owner.
3. Subscription & Payments
- Subscriptions are charged per hotel branch/outlet.
- Payments are processed in advance. Failures to renew subscriptions will result in temporary suspension of the QR ordering features.
- We offer a 14-day free trial for new hotel signups. Upon expiry, the hotel must select a paid plan to continue using the services.
4. Sales Partner Commissions
Sales agents earn Level 1 and Level 2 commissions based on subscription configurations. Commissions are only generated on actual payments cleared by referred hotels. SwadPay reserves the right to audit and withhold payments in cases of referral fraud or violation of marketing policies.
5. Limitation of Liability
In no event shall SwadPay be liable for any indirect, incidental, special, or consequential damages arising from server downtimes, transaction processing delays, or restaurant service errors.
